Terms of Service

These Terms of Service ("Terms") govern your access to and use of the LittleTrips website and travel agency management application (together, the "Service"). By creating an account, accepting an order form, or using the application on behalf of an agency, you agree to these Terms. If you do not agree, do not use the Service.
LittleTrips' legal entity name, ABN/ACN and registered address are currently pending. They will be added to these Terms and each order form when finalised.
1. About the Service
LittleTrips is software built for travel agents and travel agencies. It provides tools to manage client records, trip bookings, itineraries, supplier information, quoting, payments and commission tracking. LittleTrips is a software provider only: we are not a travel agent, tour operator, or booking agent, and we are not a party to any travel arrangement, booking or contract that you or your clients enter into with airlines, hotels, cruise lines, or other travel suppliers.
2. Eligibility and Accounts
You must be at least 18 years old and able to form a legally binding contract to use the Service. If you create an account on behalf of a business (for example, a travel agency), you confirm that you have the authority to bind that business to these Terms. Your agency is responsible for assigning access only to authorised users and for keeping account information accurate.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please let us know immediately at hello@littletrips.com.au if you suspect any unauthorised use of your account.
3. Your Data and Your Clients' Data
If you use LittleTrips to store information about your own clients, including sensitive information such as passport details, visa records, medical notes, or travel insurance, you are the controller of that data, and you are responsible for having a lawful basis to collect it, for obtaining any consents required from your clients, and for complying with applicable privacy laws (including the Australian Privacy Principles under the Privacy Act 1988 (Cth), where applicable to you). We process this data on your behalf, in accordance with our Privacy Policy, solely to provide the Service to you.
You retain ownership of the content and data you input into the Service ("Your Content"). You grant us a limited licence to host, store, and process Your Content solely for the purpose of operating and improving the Service for you.
For agency client and traveller data, LittleTrips will process the data only to provide and secure the Service and on your documented instructions; require personnel with access to keep it confidential; use service providers under appropriate obligations; take reasonable security measures; reasonably assist with privacy requests and security incidents; and make data available for export and deletion in accordance with the applicable agreement. You must give lawful instructions, maintain any required notices and consents, and respond to requests from your clients. A data processing agreement or order form may add to these commitments.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Attempt to gain unauthorised access to the Service, other accounts, or our systems;
- Interfere with or disrupt the integrity or performance of the Service;
- Upload data you do not have the right to collect, store, or share;
- Reverse engineer, resell, or use the Service to build a competing product, except to the extent permitted by law; or
- Misrepresent your identity or affiliation with any business or client.
5. Subscriptions and Fees
Where the Service is offered on a paid subscription basis, the applicable fees, billing frequency, and plan details will be provided to you separately at the time of signup or upgrade. Fees are non-refundable except where required by law. We may change our pricing from time to time, and will provide reasonable notice before any change takes effect for existing subscriptions.
Unless an order form states otherwise, fees are in Australian dollars and exclusive of GST. You must pay invoices by their due date. We may suspend access for overdue amounts after reasonable notice. Cancellation, renewal, trial and refund arrangements are those stated in the applicable plan or order form.
6. Intellectual Property
LittleTrips and its licensors retain all rights in the Service, including its software, design, documentation and branding. Subject to these Terms and payment of applicable fees, we grant your agency a limited, non-exclusive, non-transferable, non-sublicensable right for authorised users to access and use the Service during the subscription term. If you provide feedback, you permit us to use it without restriction or compensation, without identifying you unless agreed otherwise.
7. Third-Party Suppliers
Any bookings, itineraries, or travel arrangements you record in LittleTrips are made between you (or your agency) and the relevant travel supplier. LittleTrips has no involvement in, and no responsibility for, those arrangements, including pricing, availability, cancellations, or supplier conduct.
8. Service Availability
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We may perform reasonable maintenance and will try to give advance notice where practical. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law that cannot lawfully be excluded.
9. Limitation of Liability
To the fullest extent permitted by law, LittleTrips will not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of the Service, including loss of profits, revenue, data, or business opportunity. To the extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees paid by your agency for the Service in the 12 months before the event giving rise to the claim. This section is subject to rights or remedies that cannot lawfully be excluded, restricted or modified.
10. Suspension, Termination and Data
You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service if you breach these Terms, or if we reasonably believe your use poses a risk to the Service, other users, or third parties. Where reasonably practicable, we will provide notice before doing so.
On termination, your right to use the Service ends. Subject to payment of amounts due and the applicable agreement, you may export Your Content before closure. We will then delete or de-identify it in accordance with the Privacy Policy, the applicable agreement and legal retention obligations. Sections that by their nature should continue will survive termination.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable advance notice (for example, by email or an in-app notice), unless a change is required urgently for security or law. If a material change is unacceptable, you may stop using the Service before it takes effect.
12. General and Governing Law
These Terms, the applicable order form and any data processing agreement form the entire agreement about the Service. If there is a conflict, the order form prevails to the extent of the conflict. These Terms are governed by the laws of Queensland, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Queensland and the courts entitled to hear appeals from them.
